Many of Sara’s clients have questions about the ownership of the
photographs, or copyright.
The copyright to a photograph is automatically owned
by its creator, unless the creator sells the copyright to another party.
In general, Sara does not sell the copyright to her
images. The copyright is valid for the lifetime of the photographer
plus 70 years. Much of Sara’s business is stock photography sales,
so keeping the option to sell the images she creates in the future is
very important.
Clients who want to purchase the copyright can usually
come to some agreement with Sara by determining how they expect to use
the image. Do they plan to do an ad campaign in Turkey? Will they be
putting the image on a billboard in Tibet? If not, then they probably
don’t need to buy all the rights.
fees and expenses
The assignment estimate will be broken down into creative fees, digital
processing fees and expenses. Expenses include things like airfare,
car rental, and assistants. Many clients provide hotel and meals on
location. When traveling by plane on assignment for more than one client,
the airfare will be divided equally among clients.
advance
An advance of $2000 will be billed before the photo shoot. The remaining
balance will be billed when the images are delivered to the client.
two years' use
Sara tries to make life simpler for her clients by offering them unlimited
usage of the images for a period of two years, for all uses except advertising.
Four years’ use is also available at a higher rate. Advertising
is on a totally different price scale, so any advertising use is billed
separately. If clients would like to renew the original usage contract
for an additional two years, Sara charges 75 percent of the original
creative fee.
slides
If film is used on the shoot, the slides will be divided in half evenly
according to quality. Sara will keep one half for stock photography
use, and the other half will go to the client. Sara rarely shoots film
these days.
value of slides
When Sara sends an image to a magazine or a client, each image is assigned
a value of $1,500 in case of loss or damage. This sum represents the
possible income from the image over the life of the copyright. All images
must be returned to Sara when the contract expires.
electronic rights
Electronic rights provides for use on the Internet and on web sites.
transfer of rights
Rights are sold only to the original client. Third party use is considered
an additional use and will be billed accordingly. Also, “revisions,”
or images that have been changed in some way, are still considered part
of the original intellectual property and are protected under copyright
laws.
stock photography sales
Stock photography refers to sales of the images from Sara’s library
to magazines or other types of media. The price for the use is based
on factors such as the size of the image, how long the image will be
used, and the circulation of the magazine or other media. For example,
the use for a quarter-page photo in a magazine that has a circulation
of 30,000 will cost much less than a full page in a magazine with a
circulation of 1 million.

unauthorized use
Any unauthorized use will be billed at three times the normal rate for
such use.
